What is the world coming to when you can't even get a good sandwich anymore?
Well, technically you can, but it's not as simple as that. Let me explain what I mean.
You've probably eaten at Subway before and got a nice sandwich on a footlong piece of bread. In Ireland, however, this isn't much of a possibility for some anymore, and it could be the case here as well.
According to a ruling made by the Ireland Supreme Court, six varieties of the bread that Subway uses doesn't actually qualify as being called bread because of the sugar content.
Why on earth this had to be taken to the Supreme Court is ridiculous, but there appears to be a greedy motive behind the ruling.
The reason why this is an important decision though is because prior to this decision, the franchise didn't have to pay an addition 13.5% VAT didn't apply to dine in customer. Now with this new decision the bread is classified as a "confectionary" (basically a cake) and if the food is consumed on sight now, that would mean that the VAT would be applicable.
That means one of two things of course, that either they're going to charge more to cover the 13.5% VAT, or they're going to lose money on the transaction, which I doubt they'll do.
“The five-judge court ruled the bread in Subway’s heated sandwiches falls outside that statutory definition because it has a sugar content of [10%] of the weight of the flour included in the dough,” the UK paper wrote. “The act provides the weight of ingredients such as sugar, fat and bread improver shall not exceed [2%] of the weight of flour in the dough.”
“It is not necessary,” the court said in its ruling, “to consider if this is indeed what is contemplated by the [VAT] Act when it refers to the supply of food and drink, including food and drink which has been heated et cetera, because the argument depends on the acceptance of the prior contention that the Subway heated sandwich contains ‘bread’ as defined, and therefore can be said to be food for the purposes of the Second Schedule rather than confectionery. Since that argument has been rejected, this subsidiary argument must fail.”
So basically, eating a sandwich at Subway is like eating meat between two slices of cake!
