A woman from Georgia received $3 million in a lawsuit resolution, claiming she was gravely scalded by an overly hot coffee from a Dunkin' drive-thru.
Attorney Benjamin Welch of Morgan & Morgan stated in a press release that the septuagenarian woman underwent therapy to relearn walking and continues to face challenges in her daily tasks since the incident with the extremely hot beverage in February 2021.
"America may run on Dunkin, but our client had to re-learn how to walk due to the severity of her burns," Welch said. "Her burns were so severe that she spent weeks in the burn unit at Grady Health and has had to entirely alter the way she lives her life. Walking still causes her pain, she can't go out in the sun, and she must apply creams and ointments to her burns several times a day."
Welch stated that the woman visited a Dunkin' drive-thru in Sugar Hill, Georgia, where she ordered a hot coffee. When the employee passed her the drink, the lid unexpectedly came loose, causing the coffee to spill on her and resulting in second- and third-degree burns to her thighs, groin, and abdomen.
Welch mentioned that the woman accumulated medical bills exceeding $200,000 due to her injuries.
The legal action contended that the mishap could have been avoided had the drive-thru staff correctly affixed the coffee cup's lid.
Golden Donuts, LLC, which manages that particular Dunkin' outlet, consented on Tuesday to a $3 million settlement, addressing the damages and the adverse effect on the woman's life.
John Morgan, the founder of Morgan & Morgan, expressed his hope that this settlement serves as a reminder for restaurants to place customer safety at the forefront.
"One of the most famous lawsuits in American history centers around scalding coffee that caused severe burns. Yet restaurants still have failed to learn their lesson to prioritize customers' safety," Morgan said. "We hope this settlement sends a message to all restaurants and franchisees: this isn't complicated; train your employees properly and prioritize customer safety."
